PIP ADHD Appeal and Tribunal: What Happens and How to Prepare

If your PIP Mandatory Reconsideration came back unchanged, the next step is an appeal to the First-tier Tribunal. In April to June 2026, 67% of PIP decisions cleared at a tribunal hearing in England and Wales were overturned in the claimant's favour. This is a PIP-wide rate, not an ADHD-specific result — but it shows that an independent tribunal can reach a different decision.

How to Lodge Your Appeal

You have one calendar month from the date on the Mandatory Reconsideration Notice (MRN) to submit your appeal. In England and Wales, use form SSCS1 (available online through GOV.UK or by post to HMCTS). In Northern Ireland, appeal through The Appeals Service. In Scotland, if your ADP re-determination was upheld, you have 31 calendar days to appeal to the First-tier Tribunal for Scotland (Social Security Chamber).

Include a copy of the MRN, your original PIP2 or ADP form, the assessor's report, and any new evidence you want the panel to consider. You don't need to have everything ready at the point of lodging — you can submit further evidence up to the hearing date.

What the Panel Looks Like

In England and Wales, an appeal is decided by a judge sitting alone or by a tribunal panel of up to three people. A panel is always chaired by a legally qualified judge and may also include a doctor or a person with experience in disability issues. The tribunal is independent of the DWP — its job is to look at the evidence afresh, not to defend the original decision.

Hearings can be in person at a tribunal venue, by video, or by telephone. You can choose paper-only (no hearing), but an oral hearing gives you the chance to explain things the paperwork doesn't capture.

Preparing Your ADHD Evidence

The tribunal scores each activity from scratch using the same descriptors and the same reliability criteria — safely, to an acceptable standard, repeatedly, within a reasonable time. Your job is to help them understand what ADHD actually does to your daily functioning.

Evidence that carries weight at tribunal:

  • A detailed carer or partner statement describing the prompting, supervision, and practical help they give you across a typical week
  • Occupational therapy or Access to Work reports that document functional limitations and adaptations
  • GP records showing medication management, referrals, and clinical notes about executive dysfunction — request these free via a Subject Access Request rather than paying for a brief GP letter
  • A functional diary covering two weeks, noting what tasks you attempted, what help you needed, what went wrong, and how long things took

At the hearing itself:

  • Bring a companion — they can prompt you if you lose track of a question and can give their own observations when the panel invites them to speak
  • Request reasonable adjustments in advance: regular breaks for cognitive fatigue, scheduling at a time of day when your medication is effective, a quiet waiting area
  • Answer honestly about both good and bad days — the panel is applying the 50% rule, so they need to understand the range
  • If you mask well in conversation, say so explicitly: "I'm holding it together right now because this is a structured appointment, but at home without that structure I cannot manage X"

Scotland: Short-Term Assistance

If you're in Scotland and your existing ADP award was reduced or removed at review, you can apply for Short-Term Assistance (STA). This tops up your income to match your previous award level while your re-determination and any appeal are processed. STA is non-repayable even if the tribunal ultimately dismisses your appeal.

Don't Go Alone

Some Citizens Advice services, local welfare rights services, and disability charities (Mind, Disability Rights UK, ADHD UK) can help prepare an appeal; representation depends on the provider and location. A structured ADHD claim guide helps you map your evidence to each descriptor and build a reliability case before the hearing, so you arrive with everything organised.
