Short-Term Assistance for Adult Disability Payment in Scotland
Short-Term Assistance is one of the most important protections in Scotland's social security system — and one of the least understood. If your ADP award is reduced or stopped after a review, STA keeps your income steady while you challenge the decision. It exists so that no one has to choose between accepting a cut and paying the bills.
When STA Is Available
STA applies in one specific situation: you had an existing ADP award, and a decision has reduced or stopped it. You then request a redetermination or lodge a tribunal appeal against that decision.
STA is not available for first-time applicants who were refused. If you applied for ADP and received a nil award, you had no existing award to protect, so STA does not apply to your situation.
The trigger conditions are:
- You were receiving ADP at a certain rate
- A review or change of circumstances decision reduced your award or stopped it entirely
- You apply for Short-Term Assistance and challenge the decision through redetermination or appeal
How Much STA Pays
STA tops up your income by paying the exact difference between your previous higher award and your new reduced award. If you were receiving Enhanced Daily Living (£114.60/week) and the review dropped you to Standard (£76.70/week), STA pays £37.90/week — the gap — for as long as the challenge is active.
If your award was stopped completely, STA pays the full amount of your previous award.
The Non-Repayment Rule
If your redetermination or appeal is unsuccessful — the original reduction stands — you do not have to repay the STA you received, provided you were entitled to it. This is a statutory safeguard. You will not be asked to hand back money that was correctly paid during the challenge period.
An overpayment of STA can only be recovered if it was caused or contributed to by you, or if you could reasonably have been expected to notice it.

How to Apply
You need to apply for STA — it is not automatic. Contact Social Security Scotland on 0800 182 2222 or apply through mygov.scot. Apply as soon as you know you are going to challenge the decision, ideally at the same time as you submit your redetermination request.
Timing and the 42-Day Window
The clock for requesting a redetermination is 42 calendar days from when you were informed of the right to request one. If your STA application is successful, payments start from the date your redetermination or appeal request was accepted and continue until a decision is made on the challenge. If the redetermination goes against you and you appeal to the First-tier Tribunal, STA can continue through the tribunal process.
Late redetermination requests (up to one year) can be accepted if good reason for the delay is established, but STA coverage depends on having an active challenge — so the sooner you request it, the sooner STA begins.
STA and Other Benefits
STA does not make you eligible for benefits from HMRC or the Department for Work and Pensions. While the challenge is ongoing, you may be able to reapply for Scottish support such as Council Tax Reduction, a Blue Badge, or a National Entitlement Card bus pass. STA does not preserve Motability eligibility if your qualifying Enhanced Rate Mobility award ends; Motability will explain when to return the vehicle and what support is available. STA is not a qualifying benefit for Carer Support Payment, so it does not preserve a carer's entitlement on its own.
Our ADP claim guide explains how STA fits into the broader challenge process, from reading your decision letter through to preparing a redetermination request.
